Gov. Steve Beshear's February 16, 2015 Declaration of a State of Emergency (EO 2015-118) automatically waves the hours of service (HOS) restrictions for any driver who is delivering supplies in support of the declared emergency. For additional information please see the Federal Motor Carrier Safety Administrations regulations at 49 CFR 390.23.

KPMA members should utilize extra caution when allowing drivers to exceed the HOS in the regulations. Drivers requesting resting hours should be allowed to have enough time off to safely return to duty.

Drivers should also carry a printed copy of the state of emergency Executive Order in their trucks, especially if traveling out of state for supply pickups.
